Damage Claim Terms

Also referred to as the Security Deposit & Damage Claim Policy

These Damage Claim Terms are part of, and incorporated into, the Mennonite Your Way Terms of Service. They govern damage claims for stays booked through Mennonite Your Way (“MYW”) under the current damage-claim process. Version 1.

The damage claim limit

When a host sets a security deposit, that amount is a damage claim limit — the maximum that could ever be charged for eligible property damage from your stay under this process. It is a maximum, not a fee, and it is not money that Mennonite Your Way routinely collects or holds. The limit disclosed for your booking is fixed at the time you book, so later changes to the listing do not change it.

No routine hold or upfront charge

For new bookings, we do not routinely place an authorization hold or collect the damage claim limit at booking. Instead, when you book you authorize us to save your payment method so that an accepted or approved post-stay damage claim can be charged later, if one is ever filed. Nothing toward the damage claim limit is charged or held at booking.

Your responsibility

As a guest, you may be financially responsible for eligible damage to the property caused during your reservation, beyond normal wear and tear, up to the disclosed damage claim limit and subject to these Terms and the MYW damage-claim process.

Filing a claim

If a host believes the property was damaged during your stay, they may submit a damage claim after checkout, for an amount no greater than the disclosed limit. A host may file a claim only within 7 days after checkout.

Your opportunity to respond

You will be notified of any claim and can review it, then accept or dispute it. You have 72 hours to respond. If you accept, only the accepted amount (never more than the limit) may be charged. If you dispute, or if you do not respond within 72 hours, the claim is referred to Mennonite Your Way for review.

Mennonite Your Way review and determination

When a claim is disputed or otherwise requires review, you agree that Mennonite Your Way may review the information and evidence submitted by the host and by you, administer the damage-claim process, and determine whether the claim is approved or denied and, if approved, the approved amount— never exceeding the booking's disclosed damage claim limit. We aim for a fair outcome for both guests and hosts.

This determination governs the damage-claim process between you and the host to the extent permitted by applicable law. Nothing in these Terms waives any right that cannot be waived, and Mennonite Your Way is not acting as a court or arbitrator.

If a claim is accepted or approved

Only an amount you accept, or an amount Mennonite Your Way approves after review, may be charged to the payment method you saved for the reservation, up to the disclosed limit. A damage charge can never exceed the disclosed booking limit.

Not insurance; no reimbursement guarantee

The damage-claim process is not insuranceand is not a guarantee of payment or reimbursement to any host. Approving a claim does not mean Mennonite Your Way will reimburse a host; Mennonite Your Way does not itself pay hosts for damage, and a host is paid only to the extent an approved amount is successfully collected from the guest's payment method. Hosts remain responsible for maintaining appropriate property and liability insurance for their listings.

Cancellations

If your booking is cancelled, no damage-claim funds are captured in connection with the cancellation.

Legacy bookings

These Terms apply to bookings made under the current Mennonite Your Way damage-claim process for which the guest provided the applicable damage-claim consent at booking. Older or legacy bookings may be governed by the damage or security-deposit terms and processes that applied when those bookings were made — for example, our previous process, in which an authorization hold was placed before check-in and released or retained after the stay. These Terms do not retroactively change an older booking.
